I guess we shouldn't worry about cheating. Snazaroo has a whole line of facepaint Stamp kits. http://www.usartsupply.com/snazaroo/stamp-kits.aspx

Also kathymarie ... went shopping in my craft supplies, I have double sets of star stamps if you are interested, I certainly don't need 2. One is a cluster of three stars the other smaller stars with some swirls.

Unfortunately I would need a single star since I have to do the designs on our board and those call for a single star. I did see one the other day at Michaels but didn't buy it because 1) I wanted to use my coupon for some snaz paint I needed Smile and 2) went back to the feeling of "cheating". LOL I'll have to shake that and next time give in just to try it out.

Just got booked for the American Heart association walk. Just made another peace symbol sponge stamp in the shape of a heart. Will be "cheatin" next week for sure. Razz

First of all, Bravo on creative usage of materials! I use stencils, and stamps would be awesome too. Like so many others, my stars are just rotten, and this thread has inspired me to make my life easier with a stamp. I have a feeling there's going to be a run on craft stores this week. Smile

Next, I hate to side with the evil corporate monsters, but my husband works for Disney, and it's really little guys like us that get hurt when people infringe on copyright. I know it's not a popular stand point, but we are personally hurt by it, and sometimes I find it makes it easier for people to swallow when there is a real human face on the issue. Just like you hate it when people take your photos off the internet without permission, Disney has every right to protect its intellectual property.

I hope I don't come off preachy. This is a really touchy subject in our house because we run into so many people who don't think of it as stealing when it really is. We develop independent content for the web as well, and we are constantly having to get after people who illegally use our stuff. We pay our bills this way. Some people don't think about that. (Not you lovely people of course!)

are you saying us painting Disney Character hurts you and your husband in some way?

Tash, any time someone uses non-licensed intellectual property from Disney (i.e. painting the Ariel or Mickey on a kid) without paying for it or having permission is, in essence, stealing. Disney pays people like my husband to come up with the products and illustrations that they will then market and sell. If people don't use the official Disney stuff, Disney loses money.

I know this argument is kind of weak when it comes to face painting because, obviously, there is no product that Disney offers for face painters. However, it's a matter of principal. Most of us would resent another face painter using our photos on her site without permission. In my mind, there isn't much difference here.

The top Disney executives are still going to get their huge salaries, but the 20 people who just got laid off from my husband's studio are the ones that paid the price for Disney losing money.

I don't know if I'm making sense here. I guess what I'm trying to say is that copyright exists for a reason. It doesn't matter if it's protecting a mega corporation or an individual face painter. It's hypocritical to ignore it simply because the company being preyed on has a lot of money.

So no, your painting some Disney character probably won't hurt my family directly, but it's still part of the bigger picture. Let me just say, that I love you guys, and I don't want you to feel like I'm accusing you. I think a lot of people honestly haven't seen the issue from our (my family's) perspective, so that's why I'm sharing.

I agree perhaps that perspective was not considered... although you could see face paitnign the characters as promoting Disney for them.... encouraging them to keep loving Tinkerbell or whatever.
I know Disney just bought Marvel so there goes all our comic book heros.
I'm pretty sure they bought pixmar too so no Nemo... I think it would be really hard to refuse to do any Disney Characters.... and people would look at you a bit crazy if you said you wouldn't do it because Disney may sue you, as that is unrealistic. It may be that Because I'm in Australia that I don't worry to much about this. But my father worked in the music industry all his life and I'm sure all the downloading that goes on now would have upset him and probably affected his company and in turn our family so I do get where you are coming from.

Do you refuse to paint Spider man?

Tash, it's funny you asked about Spider Man because right after I made that last post I started talking to my husband about that very thing. I did have a Spider Man mask on my webpage gallery, and after we talked about it, I decided to take it down. I think what I may do it create a Spider Man-like mask and offer that. I've seen some people do it with a little spider in the middle, and that's different enough that I feel like it would be okay.

The way I get around the character thing is by saying that I have a Tinkerbell mask (green fairy mask) or a princess crown. Usually people are okay with that. I know my cheek art characters aren't as cute as my masks anyway, so they'll be happier with the end result.

Since my explanation is pretty legit (I don't want to compete with my husband's employer), I've never had a problem telling people that I don't paint licensed characters. I also don't offer an licensed characters on my board (not even Spider Man) so I don't get many requests for them anyway.

I really appreciate your understanding tone about this. I feel like I went a little too far, and I hope I didn't offend anyone. We all have our personal causes, and this is one of mine.


*edit* Tash, I just went and looked at your gallery. You work is great, and all the kids look really happy, which is always a sign of a great face painter. Smile Both your Spider Man and your Batman are different enough from the comic books to not pose a problem as far as I'm concerned.

In truth I couldn't paint them exactly the same anyway! lol
It just got me thinking.... it's no just Disney..... I mean Nickolodeon owns the rights to Sponge BOB and more, if we were going to consider Disney then we would have to consider ALL characters in general as they would all be copywrited to someone somewhere.

I do think that Disney has a write to protect there characters and rites especially from the people who make money out of fake shirts - backpacks - showbags and the like... as these people ARE trying to make money directly off Disney. But we are just trying to give the kids what they want. We are just as happy to paint a tiger - then spiderman - but it's what the kid wants that's makes us paint spidy in the first place.

If the people from Kung foo panda told us we couldn't paint a panda or a tiger anymore what would we do?
I honestly think Face painters should be exempt from getting sued for copy-write from these monster companies. They have nothing to gain by stopping us. I just fail to see how me painting one of their characters hurts them in anyway.... now if all I painted was Disney Characters all the time then yes I could see they would want to stop this - maybe.
But my Dad's record company didn't go after DJ's playing their tracks for good reason... and this really is exactly the same thing.

Thank-you for giving me your side of things - it helps to see where you are coming from - even if we agree in the end or not.

Tash, I can totally see your point, and I agree with you in a lot of ways. Really, your work probably helps Disney more than anything. I think ultimately, we have to make these decisions based on our personal experiences and gut feelings. I haven't been painting that long, so who know? Maybe I'll change my tune after I encounter some more disappointed kids. I'm greatful for your understanding and insight. That's why I love this forum. People here are really interested in helping each other. Laughing

I totally agree with tash, we are no selling a fungible item, sometimes you see the little boys with a spiderman shirt and shoes, obviosly they want a spidey face paint too, that Disney can't sell at stores I don't see any harm on it.

If it were a hard item that lasted, I could possibly understand it, but we're a temporary basis. I do like having a reason to NOT encourage kids' inordinate adoration of these darn characters, though!(Not to mention what a pain it is to try and copy them accurately!) So yay for Disney police,ha!

Ya know... the Disney police are everywhere... if you are using a licensed character stamp and CHARGING for the resulting artwork you MIGHT be breaking copyright laws.

I know of case of crafters using Disney fabrics and selling the things they made out of it being sued and/or shut down.

The products are "for personal use only" and not to be used on a resale basis... Just a heads up it you are wanting to use Disney characters.

And face painters have received letters from Disney lawyers for having images of Pooh etc on their displays and painting them![quote]
If you have it on your boards yes you are breaking copyrights but just painting them is not because it's not permanent. It's a service not a product. At least that's what the state of Missouri told me that is why face painters don't need a business license in my state. Besides their paying for your service as an artist and the time you take the end picture is unimportant. If it was a real tattoo then they may have more of a case but do you see Disney going after tattoo artists?

I got some foam 'fake tattoo' stamps to use, and I love them!

As for the copyright issues, how different would a spiderman face need to be so as not to breach copyright?
